No matter which route may be best for obtaining successful results for a client, whether that is through motions practice, settlement negotiations, trial, and even pursuing appeals, Michael is superbly capable of achieving his clients’ goals.

Business Litigation & Alternative Dispute Resolution

  • In a mandamus investor dispute case against Colorado companies operating internationally, through motions practice, Michael successfully argued that the case be dismissed for the plaintiffs’ failure to exhaust all of their remedies prior to bringing suit. Michael also successfully argued that the defendant companies be awarded their attorneys’ fee for the plaintiffs’ groundless and frivolous lawsuit.

Business, Construction & Employment Litigation

  • In a case against a Colorado contractor, and three of its employees as individuals, which alleged breach of contract and tortious conduct against all of them, Michael successfully argued at oral argument that the economic loss rule barred any claims against the individual employees and the court dismissed them from the case.

Construction & Business Litigation

  • In a case against a Colorado contractor alleging breach of contract and tortious conduct, through motions practice, Michael successfully argued that the case be dismissed for the court’s lack of subject matter jurisdiction, and for the plaintiffs’ lack of standing, because the contract at issue between the parties contained language suggesting plaintiffs waived their right to bring suit against the defendant contractor. The court granted Michael’s motion and dismissed the case.

Administrative, Insurance & Employment Litigation

  • In an administrative action brought to revoke the license of a medical doctor for alleged medical malpractice, Michael’s team successfully defended the doctor through a lengthy administrative hearing which essentially acted as a trial. As a result, the administrative law judge found in favor of the doctor and the doctor retained his license to practice medicine in Colorado.
