James F. Hayes focuses his practice on insurance defense, specializing in catastrophic personal injury and wrongful death cases.  James has defended business owners and individuals in complex tort cases.  He has extensive experience defending claims of negligence and wrongful death arising from accidents involving motor vehicles and construction sites as well as premises liability claims.

In addition, James has defended assisted living facilities from allegations of negligent conduct and for alleged violations of the Elder Abuse and Dependent Adult Civil Protection Act.  James has also represented insurance companies regarding a variety of coverage related issues.


Abuse and Neglect Litigation

  • Represented owner of a nonprofit daycare facility and successfully obtained summary judgment in its favor after plaintiff’s demand of $450,000. Plaintiff alleged negligent hiring/supervision of employees and abuse of patients. The summary judgment motion argued there was no duty of care owed to plaintiff and that plaintiff had failed to proffer any admissible evidence in opposition to the defense motion.  The court agreed and dismissed the entire case.  Plaintiff subsequently filed a motion for new trial and motion for reconsideration that were denied by the court.
  • Represented owners, licensees, and administrators of residential care facilities for the elderly and adult residential facilities involving claims of abuse, neglect, and wrongful death.  Took depositions of treating physicians, investigators from the Department of Social Services, paramedics, employees of the Inland Regional Center, and percipient witnesses.
  • Successfully had the owner of a residential care facility for the elderly dismissed from a case.  The owner had been named individually, which subjected her to personal liability, in a case alleging negligence, elder abuse/neglect, and wrongful death.

Insurance Coverage Litigation

  • Represented an insurance company in a coverage dispute and successfully obtained a defense verdict during a bench trial where plaintiff (insurer) sought to recover $175,000 funding the defense of the underlying lawsuit

Personal Injury Litigation

  • Defended clients involved in motor vehicle accidents against plaintiffs’ claims of severe personal injury. Took or defended more than 50 depositions in these cases, including treating physicians, percipient witnesses, police officers, and plaintiffs.
  • Represented construction companies in a variety of cases involving catastrophic workplace injuries resulting from falls, heavy machinery vs. pedestrians, and motor vehicle accidents.
